Unsolicited Submission of Materials

Neither collectively or individually, Toby Simkin’s Broadway Entertainment, 沈途彬商务咨询(上海)有限公司 nor Toby Simkin accepts any unsolicited information or material including, without limitation, show pitches, concepts, formats, scripts, ideas, or any other material or information.

As a matter of policy, our employees, agents, representatives, officers and directors are not permitted to accept or consider unsolicited submissions, including, without limitation, submissions of ideas or concepts, articles, pitch documents, treatments and scripts. Our policy is too delete or discard any such submissions without reading, forwarding, or responding to them. Therefore, any similarity between an unsolicited submission and any element in any of our creative work would be purely coincidental.

Based on this policy, we will not, and have no obligation to, treat any unsolicited submission as confidential or proprietary, and will incur no liability in the event that an unsolicited submission is inadvertently opened, read or responded to by any of our employees or agents.

Any solicited submission, digitally preferred, must be accompanied with a prior written agreement between us and the submitting person or entity, which allows us to exploit such solicited submission in any way, at our sole discretion, in accordance with the prior written agreement, describing any compensation, credit or notice whatsoever.   By sending a solicited submission, he or she waives the right to make any claim against us, including without limitation, unfair competition, breach of contract or breach of confidentiality, that is not otherwise agreed in the prior written agreement.
